Договор присоединения о дарении
денежных средств
1. Общие положения
1.1 Настоящий Договор присоединения (далее — Договор) содержит условия, на которых Даритель, соответствующий требованиям Договора, может передать в дар Микушиной Татьяне Николаевне* (далее — Одаряемый) денежные средства.
1.2 Настоящий Договор регулируется статьей 428 и главой 32 Гражданского кодекса Российской Федерации. Договор заключается путем присоединения Дарителя к условиям настоящего Договора.
1.3 Настоящий Договор подчиняется материальному праву Российской Федерации.
1.4 Дарителем по настоящему Договору может быть дееспособное физическое лицо, человек, не являющийся гражданином Российской Федерации (и/или личный закон которого не является правом Российской Федерации согласно статье 1195 Гражданского кодекса Российской Федерации).
1.5 Местом заключения Договора считается город Омск, Российская Федерация.
1.6 Заключая Договор, Даритель в соответствии с Федеральным законом Российской Федерации № 152-ФЗ «О персональных данных» дает согласие на обработку своих персональных данных для целей исполнения настоящего Договора любыми не запрещенными законом способами без ограничения сроком.
1.7 Даритель обязуется исполнить настоящий Договор в соответствии с требованиями законодательства Российской Федерации и законодательства страны Дарителя, в том числе регулирующего порядок осуществления денежных переводов.
2. Предмет Договора
2.1 По настоящему Договору Даритель безвозмездно передает Одаряемому денежные средства в валюте ЕВРО в размере, самостоятельно определяемом Дарителем, а Одаряемый принимает эти денежные средства в дар.
2.2 Дарение денежных средств по настоящему Договору осуществляется в форме безналичных расчетов.
3. Порядок заключения Договора
3.1 Для заключения Договора Даритель обращается к Одаряемому по электронной почте info.money2020@gmail.com с предложением передать в дар определённую Дарителем денежную сумму в валюте ЕВРО и обязуется сообщить своё полное имя, страну проживания и другие сведения о себе, которые пожелает.
3.1.1 Одаряемый вправе запросить иные сведения о Дарителе, если это предусмотрено законодательством Российской Федерации.
3.1.2 Адрес электронной почты, с которого Даритель обратился к Одаряемому, считается контактным адресом Дарителя, если Даритель специально не укажет иного.
3.2 В случае согласия принять дар Одаряемый сообщает Дарителю электронным письмом номер своей банковской карты или реквизиты банковского счета в валюте ЕВРО.
3.2.1 Одаряемый вправе отказаться от дара путем отправки ответного письма Дарителю по электронной почте, в этом случае Договор считается незаключенным.
3.3 Датой заключения Договора между Дарителем и Одаряемым является дата поступления денежных средств в валюте ЕВРО от Дарителя на банковский счет Одаряемого.
4. Прочие положения
4.1 Совершая действия, предусмотренные настоящим Договором, Даритель подтверждает, что ознакомлен с условиями и текстом настоящего Договора, осознает значение своих действий и их последствия, имеет полное право на их совершение и полностью принимает условия настоящего Договора.
4.2 Заключая Договор, Даритель тем самым подтверждает, что на момент заключения Договора он действует по доброй воле, от своего имени, за свой счет и в своем интересе.
4.3 Стороны Договора подтверждают, что действуют добросовестно, в соответствии с законодательством, применимом к их действиям при заключении и исполнении настоящего Договора, и сообщают друг другу достоверную информацию.
4.4 Одаряемый обязуется в течение 3 дней сообщить Дарителю о получении дара письмом по электронной почте.
4.5 Даритель обязуется при необходимости предоставить Одаряемому документы или информацию в связи с заключением и исполнением Договора, если это требуется по основаниям, предусмотренным законодательством Российской Федерации и/или по запросу банка или компетентных государственных органов.
5. Действие Договора
5.1 Условия настоящего Договора размещены на персональном интернет-сайте Одаряемого http://sirius-eng.net (далее – Сайт) по адресу https://sirius-eng.net/dogovor-oferty.htm.
5.2 Условия Договора действуют, и Дарители могут вступать в Договор без ограничения сроком, пока его текст размещён на Сайте, при этом Одаряемый вправе отменить Договор в любое время без объяснения причин. В Договор могут быть внесены изменения и дополнения, которые вступают в силу со дня, следующего за днем их размещения на Сайте. Недействительность одного или нескольких условий Договора не влечет недействительности всех остальных условий Договора.

Agreement on the Donation and
Acceptance of funds
1. General provisions
1.1 This Agreement (hereinafter, the Agreement) contains the terms in which a Donator who meets the requirements of the Agreement may transfer a gift to Tatiana N. Mikushina* (hereinafter, the Donee) in the form of money (funds).
1.2 This Agreement is governed by Article 428 and Chapter 32 of the Civil Code of the Russian Federation. The Agreement is concluded by accession of the Donator to the terms of this Agreement.
1.3 This Agreement is subject to the substantive law of the Russian Federation.
1.4 A Donator under this Agreement shall be a capable individual, a person who is not a citizen of the Russian Federation (and/or whose personal law is not the law of the Russian Federation according to Article 1195 of the Civil Code of the Russian Federation).
1.5 The place of conclusion of the Agreement shall be the City of Omsk, Russian Federation.
1.6 By entering into the Agreement the Donator, in accordance with the Federal Law of the Russian Federation No. 152-ФЗ "On Personal Data", consents to the processing of his personal data for the purposes of the performance of this Agreement by any means not prohibited by law, without a time limit.
1.7 The Donator undertakes to execute this Agreement in accordance with the requirements of the legislation of the Russian Federation and the legislation of the Donator's country, including the regulation of the procedure for making money transfers.
2. Subject of the Agreement
2.1 Under this Agreement the Donator shall transfer (bestow) funds in the EURO currency to the Donee free of charge in an amount independently determined by the Donator, and the Donee shall accept such funds as a gift.
2.2 Donation of money under this Agreement shall be carried out in the form of non-cash payments (cashless settlement).
3. Procedure for concluding the Agreement
3.1 To conclude the Agreement the Donator shall send to the Donee’s email address info.money2020@gmail.com a proposal to donate some amount in EURO currency at the discretion of the Donator. The Donator shall provide his/her full name, country of residence and other information about oneself which the Donator wishes.
3.1.1 The Donee has the right to request other information about the Donator, if this is provided for by the legislation of the Russian Federation.
3.1.2 The e-mail address from which the Donator addressed the Donee is considered to be the contact address of the Donator, unless the Donator specifically specifies otherwise.
3.2 If the Donee agrees to accept the gift, the Donee shall inform the Donator by e-mail of her bank card number or bank account details in EURO currency.
3.2.1 The Donee has the right to refuse the gift by sending a reply letter to the Donator by e-mail, in which case the Agreement shall be considered not concluded.
3.3 The date of conclusion of the Agreement between the Donator and the Donee is the date of receipt of funds in EURO currency from the Donator to the Donee's bank account.
4. Other provisions
4.1 By performing the actions provided for in this Agreement, the Donator confirms that he / she is familiar with the terms and text of this Agreement, understands the meaning of his / her actions and consequences thereof, has the full right to perform them and fully accepts the terms of this Agreement.
4.2 By entering into the Agreement the Donator hereby confirms that at the time of entering into the Agreement he / she is acting of the own free will, on his / her own behalf, at his / her own expense and in his / her own interest.
4.3 The Parties to the Agreement confirm that they act in good faith, in accordance with the legislation applicable to their actions during the conclusion and execution of this Agreement, and provide each other with reliable information.
4.4 The Donee undertakes to inform the Donator of the receipt of the gift by e-mail within 3 days.
4.5 The Donator undertakes, if necessary, to provide the Donee with documents or information in connection with the conclusion and execution of the Agreement, if this is required on the grounds provided for by the legislation of the Russian Federation and/or at the request of the bank or competent state bodies.
5. Validity of the Agreement
5.1 The terms of this Agreement are posted on the personal website of the Donee (hereinafter referred to as the Website) http://sirius-eng.net at https://sirius-eng.net/dogovor-oferty.htm
5.2 The terms of the Agreement are valid and the Donators may enter into the Agreement during an unlimited period till its text is posted on the Website, meanwhile the Donee has the right to cancel the Agreement at any time without giving reasons. The Agreement may be amended and supplemented, and such amendments shall come into force on the day following the day of posting them on the Website. The invalidity of one or more terms of the Agreement does not entail the invalidity of all other terms of the Agreement.
